Terms of use

This agreement is concluded between you and JLTECH LLC only, and not with Apple. JLTECH LLC — not Apple — is solely responsible for Spott3D and its contents. Apple has no obligation whatsoever to furnish any maintenance or support services for Spott3D.

You are granted a non-transferable licence to use Spott3D on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, and by these terms. The licence may be accessed by other accounts associated with you via Family Sharing or volume purchasing.

You may not distribute or make the game available over a network where it could be used by multiple devices at the same time. You may not rent, lease, lend, sell, redistribute or sublicense it. You may not copy, decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify or create derivative works of the game or any part of it, except to the extent that the law expressly permits it despite this limitation.

The game, its code and its artwork remain the property of JLTECH LLC and its licensors. The licence does not transfer ownership of anything.

JLTECH LLC is solely responsible for providing any maintenance and support services for Spott3D, as specified in these terms or as required by law. Apple has no obligation to furnish any maintenance or support services.

JLTECH LLC is solely responsible for any product warranties, whether express or implied by law, to the extent they have not been effectively disclaimed.

In the event of any failure of Spott3D to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the game to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Spott3D. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are the sole responsibility of JLTECH LLC.

Except where the law provides otherwise, the game is provided “as is”, without warranty of any kind. Nothing in these terms limits any statutory rights you have as a consumer that cannot be limited.

JLTECH LLC, and not Apple, is responsible for addressing any claims by you or any third party relating to Spott3D or your possession and use of it, including but not limited to: product liability claims; any claim that the game fails to conform to any applicable legal or regulatory requirement; and claims arising under consumer protection, privacy, or similar legislation.

In the event of any third-party claim that Spott3D or your possession and use of it infringes that third party’s intellectual property rights, JLTECH LLC, and not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.

You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Spott3D is published by JLTECH LLC. Any questions, complaints or claims about the game should be directed to jesse@jlte.ch.

You must comply with any applicable third-party terms of agreement when using Spott3D — for example, your wireless data service agreement.

You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these terms, and that upon your acceptance of them, Apple will have the right — and will be deemed to have accepted the right — to enforce these terms against you as a third-party beneficiary of them.

Spott3D collects nothing about you. What it stores, where it stores it, and the one request it makes over the internet are set out in full in the privacy policy, which forms part of these terms.

These terms may change as the game changes. If they do, the date at the top of this page changes with them, and the current version is always the one published here.
